BIR QC ASSISTANT REGIONAL DIRECTOR SUSPENDED FOR FAILURE TO ACCURATELY DECLARE PROPERTIES IN HER SALNs

Assistant Regional Director Marina C. De Guzman of the Quezon City Revenue Region No. 7, Bureau of Internal Revenue (BIR) was found guilty of Simple Neglect of Duty by the Office of the Ombudsman, suspending her for three (3) months without pay.

The Department of Finance-Revenue Integrity Protection Service (DOF-RIPS) filed an administrative complaint in February 16, 2006 for Dishonesty and Grave Misconduct against De Guzman. However, the Ombudsman in its recent Decision found no sufficient evidence to hold De Guzman liable for the said charges. Instead, it held that De Guzman’s failure to accurately declare some properties as Simple Neglect of Duty.

The Anti-Graft Body believes that De Guzman failed to declare in her SALNs for 1994, to 1996, the land in Malibo, Matanda, Pandi Bulacan which she bought in 1982, and the house and lot she acquired in Marilao, Bulacan in 1985. She also omitted in her SALNs for 1997-1999 the agricultural rice land in Masuso, Pandi, Bulacan, which she acquired through donation in 1996. De Guzman, according to the Ombudsman, did not also declare in her 1999 and 2000 SALNs the memorial lot in Dasmarinas, Cavite, which she acquired in 1997.

Although De Guzman was not found guilty of Dishonesty and Grave Misconduct, the DOF-RIPS still consider this as a victory against government personnel who may consider true and accurate SALN declaration as of no importance. The DOF-RIPS believes that the 3-month suspension without pay meted on De Guzman will send a strong message to the public that the Government will not hesitate to prosecute wrong-doers in the public service.

The DOF-RIPS also found the promulgation of the Ombudsman’s Decision on De Guzman’s case as an occasion to encourage the public to be vigilant against accumulation of unexplained wealth of public servants. The DOF-RIPS encourages people to report through the perangbayan.com of the Finance Department any signs of unexplained wealth such as high-end vehicles, lands and houses which may not be bought with the government personnel’s salary, travels abroad and other ostentatious display of wealth.
